Terms of Service

1. Definitions

  • Webey: the platform for building and managing websites, offered via webey.nl.
  • User: any natural or legal person who uses the Service.
  • Website: the website(s) created and managed by the User through Webey.
  • Service: all features, tools, and services offered by Webey, including hosting, the website editor, and related support.

2. Use of the service

By using Webey, you agree to the following conditions:

  • You must be at least 18 years old to create an account and use the Service.
  • Only one account per person is permitted.
  • You are responsible for the security of your account, including keeping your password confidential.
  • It is not permitted to use Webey for illegal purposes, including but not limited to distributing malware, phishing, or violating the intellectual property rights of third parties.

3. Account and registration

  • When creating an account, you must provide accurate and complete information.
  • You are required to keep your account details up to date.
  • Webey reserves the right to suspend or terminate accounts that violate these terms, with prior notification where reasonably possible.

4. Subscriptions and payment

Webey offers the following subscription plans:

  • Starter: €15 per month
  • Pro: €23 per month
  • Business: €49 per month
  • All subscriptions are billed monthly.
  • New users receive a free 14-day trial period.
  • You can cancel your subscription at any time. The cancellation takes effect at the end of the current billing period.
  • Prices are exclusive of VAT unless otherwise stated.

5. Intellectual property

  • The Webey platform, including all software, designs, logos, and documentation, is and remains the property of Webey.
  • All content you create or upload through Webey remains your property.
  • By using the Service, you grant Webey a limited, non-exclusive license to host, display, and make your content available in the context of the Service.

6. Availability

  • Webey aims for an annual uptime of 99.9%.
  • Scheduled maintenance is announced in advance and preferably takes place outside peak hours.
  • Webey does not guarantee uninterrupted access to the Service and is not liable for temporary interruptions due to maintenance, updates, or circumstances beyond our control.

7. Liability

  • Webey’s liability is limited to the amount the User has paid to Webey in the past 12 months.
  • Webey is not liable for indirect damages, including consequential damages, lost profits, missed savings, or damages due to business interruption.
  • Webey is not liable for damages resulting from force majeure, including but not limited to natural disasters, internet disruptions, government measures, or pandemics.

8. Privacy

Webey places great importance on the protection of your personal data. Our privacy policy describes what data we collect, how we use it, and what rights you have. Read our privacy policy for more information.

9. Termination

  • You can cancel your account at any time through your account settings.
  • Webey may terminate your account for violations of these terms, after reasonable notice.
  • After termination, you have 30 days to export your data. After this period, your data will be permanently deleted.

10. Changes

  • Webey reserves the right to modify these terms.
  • For material changes, you will be notified at least 30 days in advance via email or a notification in the platform.
  • By continuing to use the Service after a change, you agree to the modified terms.

11. Applicable law

  • These terms are governed by Dutch law.
  • Any disputes will be submitted to the competent court in Amsterdam.
